Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Wave3 LLC, a Wyoming limited liability company (“Wave3”, “we”, “us”), covering the ZoneCoach app for iPhone and Apple Watch (the “App”), the website zone.coach, and the related servers that deliver coach audio (together, the “Service”). By downloading or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority where you live), you may use it only with the involvement and consent of a parent or guardian, who agrees to these Terms on your behalf.

2. Health and safety

ZoneCoach is a fitness guide for general wellness. It is not a medical device and does not provide medical advice, diagnosis or treatment.

• Consult a physician before starting any exercise program, especially if you have a heart condition, take medication that affects heart rate, are pregnant, or have any other health concern.
• Stop exercising immediately and seek medical attention if you feel chest pain, faintness, severe shortness of breath, dizziness or other unusual symptoms. Do not rely on the App to detect a medical problem.
• Heart-rate zones, pace, distance and other figures are estimates from your devices and may be inaccurate. Coaching based on the “talk test” is general guidance, not a personalized prescription.
• Run safely: stay aware of traffic, terrain, weather and your surroundings, keep audio at a level that lets you hear what's around you, and follow local laws.

You use the Service and exercise at your own risk.

3. Your license to use the App

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. All rights not expressly granted are reserved by Wave3.

4. Coach lines and audio

The App lets you write your own coach lines. When a line has no recording yet, the App sends its text to our servers, where it is turned into spoken audio using AI text-to-speech provided by a third party. Coach audio is synthetic; it is not recorded live by a person.

• Your content. You keep any rights you have in the text you write. You grant Wave3 and its service providers a worldwide, royalty-free license to store, process, convert to audio, and deliver that text and the resulting audio as needed to operate the Service. Because identical text produces identical audio, a recording made from your text may be reused when anyone requests the same text.
• Rules. Coach lines must not be unlawful, harassing, hateful, sexually explicit, threatening, or defamatory; must not impersonate or appear to be spoken by a real person; must not include other people's personal information; and must not infringe anyone's rights.
• Limits. We may limit how many lines can be recorded, decline to record any text, and remove content that we believe breaks these Terms.
• Use of audio. Coach audio is provided for your personal use within the App. Don't extract, redistribute or use it for other purposes.

5. Acceptable use

You agree not to:

• access our servers other than through the App, or scrape, bulk-download or automate requests to them;
• circumvent rate limits, usage limits or security measures, or generate install identifiers to evade them;
• copy, modify, reverse-engineer or decompile the App, except where the law expressly allows it;
• interfere with or disrupt the Service, or use it to break any law.

6. Third-party services

The Service works with Apple Health, Apple Watch, and music or podcast apps you choose, and relies on providers such as Google Cloud and ElevenLabs. Those services are governed by their own terms, and we are not responsible for them.

7. Our intellectual property

The App, the website, the ZoneCoach name and logo, the built-in workouts, plans, cues and music, and all related software and content are owned by Wave3 or its licensors and are protected by law. Feedback you send us may be used without obligation to you.

8. Changes and availability

We may update, change or discontinue any part of the Service at any time. Features that depend on our servers, such as recording new coach lines, may be limited, interrupted or unavailable.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that any data will be accurate.

10. Limitation of liability

To the fullest extent permitted by law, Wave3 and its members, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any personal injury, loss of data or loss of profits, arising out of or related to your use of the Service. Our total liability for any claim related to the Service is limited to the greater of the amount you paid us for the App in the 12 months before the claim or US$50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnity

You agree to indemnify and hold Wave3 harmless from claims, losses and expenses (including reasonable attorneys' fees) arising from your coach lines, your misuse of the Service, or your violation of these Terms or of anyone's rights.

12. Termination

You may stop using the Service at any time by deleting the App. We may suspend or end your access if you violate these Terms. Sections that by their nature should survive termination (including 4–7 and 9–14) will survive.

13. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Wyoming, and you and Wave3 consent to their jurisdiction, except that either party may bring a claim in small-claims court where eligible.

14. Apple App Store terms

If you downloaded the App from the Apple App Store, the following also applies:

• These Terms are between you and Wave3 only, not Apple Inc. (“Apple”). Wave3, not Apple, is solely responsible for the App and its content.
• Apple has no obligation to provide any maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Wave3, not Apple, is responsible for addressing any claims relating to the App or your use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
• If a third party claims that the App or your use of it infringes that party's intellectual property rights, Wave3, not Apple, is responsible for the investigation, defense, settlement and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using the App.
• Questions, complaints or claims about the App should be directed to Wave3 LLC, 1405 Dewar Drive #1149, Rock Springs, WY 82901, United States, support@zone.coach.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.

15. Changes to these Terms

We may update these Terms. We'll change the effective date above, and for material changes we'll give notice in the App or on this site before they take effect. Continuing to use the Service after that means you accept the updated Terms.

16. General

These Terms and the Privacy Policy are the entire agreement between you and Wave3 about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
